xMode.ai offers advanced AI-powered tools to:

• Generate images based on user-provided prompts.
• Train custom AI models using user-uploaded images.
• Replicate poses and faces for creative purposes under strict ethical and legal guidelines.

Our platform supports content creators, agencies, and professionals seeking tailored outputs. Use of the platform is governed by these terms, and users must comply with all prohibited content rules.

3. Prohibited Content

Users must not generate, upload, or attempt to generate content that:

• Depicts minors or appears to involve individuals under the age of 18.
• Includes non-consensual acts, violence, or any illegal activities.
• Features mutilation, extreme violence, or other harmful imagery.
• Contains drugs, weapons, or graphically disgusting content.
• Infringes on copyrights, trademarks, or other proprietary rights.
• Promotes hate speech, harassment, or discriminatory content.

Failure to comply will result in immediate account suspension or termination. Violations may also be reported to law enforcement.

4. AI Image Generation Rules

1. User prompts are automatically analyzed by AI for compliance.
2. Non-compliant prompts or generated images will trigger immediate action, including suspension or termination.

5. Content Moderation

xMode.ai enforces strict content moderation to ensure compliance with our rules:

• All user-uploaded images undergo manual review.
• Moderators verify that uploaded content aligns with the platform’s terms and does not include prohibited material.
• Any violations may result in the removal of content and suspension of the user account.

6. Uploaded Images and User Rights

1. Ownership and Rights: Users must have the legal rights to any images they upload to the platform. By uploading an image, you represent and warrant that:
• You are the rightful owner of the image or have obtained explicit permission from the owner or subject.
• The image does not infringe on the rights of any third party, including but not limited to copyright, trademark, privacy, or publicity rights.
2. Explicit Consent: Users are prohibited from uploading:
• Images of individuals without their explicit written consent, particularly for commercial, sensitive, or explicit purposes.
• Images that violate any intellectual property laws or legal rights of others.
3. User Responsibility: By uploading images, users agree to:
• Indemnify xMode.ai against any claims, damages, or liabilities arising from the use of uploaded images.
• Take full legal responsibility for ensuring the images comply with these Terms of Use.
4. Prohibited Uploads: Users are strictly prohibited from uploading:
• Images they do not own or have obtained proper permissions to use.
• Content that violates ethical, legal, or community standards as defined in Section 3.
5. Consequences of Violation:
• Any breach of these terms will result in:
• Immediate removal of the content in question.
• Potential suspension or permanent termination of the user account.
• Reporting to relevant authorities where applicable.
6. Audit and Verification:
• xMode.ai reserves the right to conduct audits of uploaded content to ensure compliance with these terms.
• Users may be required to provide proof of ownership or consent upon request.

7. User Responsibilities

Users are responsible for:

• Providing accurate account information during registration.
• Maintaining the confidentiality of their account credentials.
• Using the platform ethically and in compliance with all applicable laws.
• Ensuring they have rights to all uploaded content.

8. Generated Content and Ownership

1. Users retain ownership of the content they generate, including commercial usage rights.
2. xMode.ai has a limited license to store, display, and distribute user-generated content for service delivery.
3. Users are prohibited from using generated content for illegal or unethical purposes, including defamation, fraud, or harassment.

9. Model Training and User-Uploaded Images

1. User-uploaded images are processed exclusively for training purposes and are immediately deleted from our servers once the training is completed.
2. Generated images are securely stored, but users may delete them at any time.

10. Age Restriction

The platform is intended for users aged 18 and above. Users must verify their age during registration. Misrepresentation of age will result in account suspension.

11. Payment and Refund Policy

1. Payments for credits or services are non-refundable, except in cases of:
• Double billing or technical errors.
• Failure to provide the intended service.
2. Refund requests must be submitted within 14 days of purchase.

12. Compliance and Legal Jurisdiction

1. xMode.ai complies with relevant laws, including GDPR and CCPA, to ensure user data protection.
2. Any disputes will be resolved under the laws of Cyprus.

13. Termination of Access

xMode.ai reserves the right to suspend or terminate user accounts for violations of these terms or any other misuse of the platform.
